6. USER/VISITOR WITH OR WITHOUT ACCOUNT

       6.1 User/Visitor WITH User Account

Accessing this website offers a possibility to create your user account for further communication purposes set up by us via “Log In” so we could provide below features to facilitate your experience with us:

  • Faster Checkout (Name, Address, Phone No. & any relevant info are already registered, no need to re-type)

  • My Orders (List of your orders)

  • My Address book (List of all your delivery addresses)

  • My Wallet (Credit/Debit card details)

  • My Wishlist (View favorite products)

  • My Account (View, Edit your personal info)

You will be prompted on the relevant info we need to create your User Account.

 

As a standard rule, keep your credentials safe. All activities performed under your account will be deemed to have occurred on your behalf and in your name. We encourage you to log out from your User Account after your 12NOTESPARIS visit especially if your PC or the station you used is a shared device.

You may contact us if you wish to delete your User Account. We hold the right to delete any User Account deemed to not comply with our Terms of Use.

You are not obliged to create a User Account. You may browse site, purchase our products even without a User Account.

Failure to abide by any of these rules may bring us to cancel your user account and stop providing you with any of our services & might be subject for us to seek indemnification from such abusive use as stated above.

8. INDEMNIFICATION

Abusive use of this website & its contents may give rise to a claim for damages and complaints.

You agree to indemnify and hold 12NOTESPARIS harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

 

9. CONTENT OWNERSHIP

       9.1 Your Intellectual Property

You own all intellectual property pertaining to your User Account and to any other materials/contents sent by you (ie: designs, images, animations, videos, audio files, logos, illustrations, compositions, artworks, text). We do not claim ownership rights of your content, therefore you agree that we have the rights to use your content for the sole purpose of delivering you the personalized product you ordered.

 

We will explicitly send you an e-mail request if your own material will be used for marketing or any of our business needs.  

 

       9.2 12NOTESPARIS Intellectual Property

We own all rights in and to our products, services, content, and data within our business jurisdiction and website.

12notesparis is a trademark registered by INPI (Institut national de la propriété industrielle / National Industrial Property Institute) & www.12notesparis.fr is a protected domain that belongs to us.

 

Our design which is a result of any submitted request or order for a personalized artwork belongs to us. We will request explicitly your consent if we will use your own material or content.

10. FEEDBACKS AND SUGGESTIONS

All submitted feedback, suggestions or any comments relating to 12NOTESPARIS products or services will be owned by us. By providing such info, you acknowledge and agree that it may be used by us in order to develop, customize and improve our services.

12. PRICING

       12.1 France

Upon payment, you are shown the exact price along with any delivery fees that go with your purchase.

We hold the right to change our fees or product pricing anytime we deem fit, and to correct pricing errors that may inadvertently occur.

 

As needed, upon checkout/payment, you are required to input payment-related information from your relevant payment providers and banks.

 

       12.2 Other countries

If you are ordering from another country with currency other than EURO, the price will be converted to your currency value at the time of order. FX rate is determined by our payment providers & we do not hold the control & responsibility over it. The amount in your currency is shown at time of your checkout & also confirmed by the receipt.

 

Other bank fees may be incurred due to your order depending on your bank policies. We do not have the knowledge if a certain bank applies additional fees.

13. DELIVERY

We partner with our France postal services to deliver our products – local & international. 

       13.1 Delivery fees – are shown during the payment process and are shown at the receipt. 

       13.2 Delivery Status – We follow the binding status as confirmed by our delivery partner. 

       13.3 Estimate Delivery time – is shown during your delivery-check out process. Contact us if the delay estimation is not indicated during check out.

14. INVOICES/RECEIPTS

Upon checkout, you will receive receipt confirming your order stating description of product, payment amount, delivery fees, payment method, date. It will be sent to the e-mail address you registered at check out.

 

You are responsible to keep a copy of your receipt for your own bookkeeping and in an eventual refund.

15. PAYMENT PROVIDERS

We work with our regulated & certified payment providers partners that handle your online payment. They certify online payment security having the latest industry requirements. If upon checkout and on our receipt, you notice any discrepancy, we invite you to contact us immediately. This will undergo verification process with our partners and response/resolution time will depend on their capacity to resolve certain issue.

16. RETURNS

       16.1 ALL PRODUCTS TO BE RETURNED SHOULD BE UNOPENED AND IN THEIR PROTECTIVE, TRANSPARENT WRAP. You will be requested to provide a reason of the return.

 

       16.2 RETURNS ARE NOT POSSIBLE for any personalized product, artworks, business cards, logos or alike due to misspellings caused by the customer or any issue related to fonts, size – all these described elements are presented & reviewed/approved by the customer before check out.

       16.3 Return option with our delivery partner is available only in France mainland, Corsica, Monaco, Andorra. 

 

       16.4 Instructions:

•    Contact us to have the return slip.
•    Be sure that the return slip is readable & its barcodes are intact. 
•    Include the original receipt in the package.
•    Be sure to only use the return slip showing the return address and the relevant barcodes. Do not include the initial delivery slip to avoid any confusion.
•    Deposit the package to be returned in the same delivery company, within 15 days from the time the product was delivered to you.

 

 If the packaging cannot be re-used, you may use another packaging at your expense. 

The return is free of charge for the above conditions.

17. REFUNDS

       17.1 Refund can be issued upon request within 15 days from the delivery date, following our above return policy. 
We refund the product amount paid during check out. You will see the refund approximately 5-10 business days later depending upon your bank.
We reserve the right to dispute any refund request if we deem it abusive & not requested in good faith. We review request in a case-to case basis.

       17.2 FOR ANY PERSONALIZED PRODUCT AFTER REVIEW/ APPROVAL BY CUSTOMER AND PRINTED ALREADY WILL NO LONGER BE VALID FOR REFUND CLAIMS.

       17.3 REFUND REQUESTS ARE NOT VALID FOR DIGITAL PRODUCTS.

18. DISCLAIMER OF WARRANTIES FOR THE WEBSITE

Your use of any link, information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services, or information available through this website meet your specific requirements upon checkout. If any doubt, please contact us first.

19. WARRANTIES & RESPONSIBILITY FOR SERVICES AND PRODUCTS

When we receive a valid warranty claim for a product purchased from us, we will either repair the relevant defect or replace the product. If we are unable to repair or replace the product within a reasonable time, the customer will be entitled to a full refund upon the prompt return of the product to us. We will pay for shipment of repaired or replaced products to customer and customer will be responsible for return shipment of the product to us.

 

Any error coming from you that may occur after you had approved, reviewed any artwork or any of our products which we already printed or delivered will be replaced under your own expense.

20. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, in no event shall 12NOTESPARIS or its representative, be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, our service or product.

 

21. SERVICE NOTIFICATION

We have the rights to contact you through your registered contact details (phone or e-mail or physical address) with regards to your ordered product.

22. PROMOTIONAL EMAILS AND CONTENT

Following your consent, you will receive from time-to-time promotional messages and materials from us, by mail, email, or any other contact form you may provide us with (including your phone number for calls or text messages). If you do not want to receive such promotional materials or notices – please notify us any time.
